Terms and Conditions

By purchasing tickets and clicking the checkbox below, you agree to the following terms:
1. Admission & Activities
Your ticket grants access to Downey’s Apple Farm, including general entry to the farm, wagon rides (wagon rides weekend only), Farmer Downey’s Play Area, and the farm market (the “Activities”).
Apples and all merchandise are sold separately and are not included in the ticket price.
Activities may vary due to weather, crop conditions, or operational needs.
2. Ticket Policy
All ticket sales are final. Tickets are non-refundable and non-transferable unless otherwise stated. Please ensure you select the correct date and time before purchasing.
Entry is only valid for the date and time listed on your ticket.
3. Health & Safety
All visitors must follow posted rules and instructions from staff. Farm equipment and orchards must be treated with care and respect.
Children must be supervised at all times. Downey’s Apple Farm is not responsible for injuries caused by failure to follow rules or unsafe behavior.
4. Weather Policy
The farm operates rain or shine. Some activities may be suspended or unavailable due to inclement weather, but tickets will not be refunded due to weather conditions unless the farm is closed entirely.
5. Assumption of Risk
WARNING: under Ontario law, an agritourism provider is not liable for the death or injury or illness of a participant in an agritourism activity conducted at this agritourism location if that injury or death or illness results from the inherent risks of that agritourism activity. Inherent risks of agritourism activities include, but are not limited to, the risk of injury inherent to land, equipment and animals as well as the potential for you as a participant to act in a negligent manner that may contribute to your injury or death. You are assuming the risk of participating in this agritourism activity.
By entering the property, you acknowledge that farm activities involve inherent risks, including uneven ground, insects, allergens, and physical activity. You accept full responsibility for your own safety and that of any minors in your care. You hereby expressly waive and release any and all claims which you have or may in the future have against Downey’s Apple Farm Inc., its affiliates, and their respective directors, officers, employees, agents, representatives, shareholders, successors, and assigns. (collectively, "Releasees"), arising out of or attributable to the Activities, due to any cause whatsoever, including without limitation the negligence of Downey’s Apple Farm Inc.or any other Releasee, breach of contract, or breach of any statutory or other duty of care owing under occupiers liability legislation or otherwise. You covenant not to make or bring any such claim against Downey’s Apple Farm Inc. or any other Releasee, and forever release and discharge Downey’s Apple Farm Inc.and all other Releasees from liability under such claims.
6. Photography & Media
By attending, you consent to yourself and any minors in your care being photographed or filmed for promotional purposes. If you do not wish to be included, please notify staff upon arrival. You hereby grant and convey to the Downey’s Apple Farm Inc. all right, title, and interest, including but not limited to, any royalties, proceeds, or other benefits, in any and all such photographs or recordings, and consent to the Downey’s Apple Farm Inc.’s use of your name, image, likeness, and voice, or the name, image, likeness, and voice of any minors in your care in perpetuity, in any medium or format including but not limited to use through email, website, social media and printed materials, for any publicity without further compensation or permission
7. Privacy
Personal information collected during the ticket purchase process will be used solely to process your order and communicate relevant farm updates. We do not share or sell your information.
8. Right to Refuse Entry
Downey’s Apple Farm reserves the right to deny entry or remove any guest for unsafe, inappropriate, or disruptive behavior, without refund.
